Terms and conditions
General:
The delivery and payment terms and conditions apply to all orders, offers and agreements. When you place an order, you indicate your agreement to the terms and conditions.
Cancellation:
If you wish to cancel an order, you must notify us within 24 hours at info@byindah.nl Payment will then be refunded to the account number you provided within 5 working days.
Payment
1) By bank transfer
Payment of the order can be made by bank transfer to bank account number NL25 KNAB 0257037136 t.n.v. by Indah in Hengelo. Bank transfers must be made within 5 working days of ordering. Placing an order is a legally valid purchase agreement. As soon as the money is in our account, the order will be sent.
2) Via Ideal

4) Via Paypal, we charge a part (3.4% over the total sales amount) of the costs to the buyer.
Delivery time/Shipping:
Upon receipt of your payment, the goods will be dispatched as soon as possible. At the latest within 48 hours.
If items ordered are not available, this will be visible on the site. Should your order have just been placed at the same time as another order (as a result of which the stock on the site is incorrect), you will receive an e-mail from us informing you that these items are sold out. We obviously do our utmost to minimise the number of sold-out items and tailor product availability to your needs. Unfortunately, however, we cannot guarantee that your desired items will always be available.
Shipping costs:
All prices quoted do not include shipping costs. These are automatically calculated during your order. Packing & Shipping costs within the Netherlands are € 2,25 per order. For orders above € 20,= we do not charge shipping costs.
Shipping costs within Europe is € 3,- per order and free for orders above € 30,-.
Shipping to the rest of the world is € 4,- per order and free for orders over € 40,-.
All orders are neatly, securely and carefully packed prior to dispatch. No liability is accepted for loss and/or damage during shipping by PostNL www.byindah.nl.
Prices:
All prices are stated in euro`s, including 21% VAT, excluding shipping costs.
Returns or exchanges:
If, upon receipt, you do not wish to keep an item, it can be returned within 14 days of receipt. Provided the article is unused (= not worn). With the exception of our jewellery made personally for you. Before returning an article we would like to receive an e-mail (info@winkelvanindah.nl) about this. The article must be sent in the same or similar protective packaging and the return form must be completed and enclosed. The amount due (without shipping costs) will be refunded to your account within a week after receipt of the article (if in undamaged condition). In case of returns, the shipping costs will be borne by the customer.

Warranty:
On all items, Winkel van Indah gives a one-month warranty on the jewellery from the day of shipment.
With the exception of:
-Stains caused by the use of hairspray, perfume and cosmetics
-Metal discoloured by contact with water
-Metal that is discoloured by the acidity/PH value of the skin
-Items that have been broken/damaged by being dropped
-Injuries caused by improper use of the items
Liability:
Shop by Indah is not liable for damage to delivered items due to wear and tear or improper use. In case of any liability, it is maximum in the amount of the purchase price of the item.
Complaints procedure
1. The entrepreneur has a sufficiently publicised complaints procedure and handles complaints in accordance with this complaints procedure.
2. Complaints about the execution of the agreement must be submitted to the entrepreneur within 7 days fully and clearly described, after the consumer has discovered the defects.
3. Complaints submitted to the entrepreneur shall be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within the 14-day period with a notice of receipt and an indication of when the consumer can expect a more detailed answer.
4. If the complaint cannot be resolved by mutual agreement, a dispute arises which is subject to the dispute settlement procedure.
Disputes
1. On agreements between the entrepreneur and the consumer to which these general terms and conditions relate, only Dutch law applies. Also if the consumer resides abroad.
2. The consumer can submit the dispute to the disputes committee via the ODR platform ( http://ec.europa.eu/consumers/odr/)
Warning:
Despite the jewellery being solidly made from excellent materials, wearing it by small children ( e.g. while playing) can pose health risks. Think of swallowing parts. Therefore, keep a close eye on children while wearing our jewellery. Do not leave them alone and take off the jewellery at bedtime. Shop by Indah is not liable in any way.
Modification right:
www.byindah.nl reserves the right to make interim changes to the terms and conditions and content of its website.

Our web shop is developed with software from Shopify. Personal data that you make available to us for the purpose of our service is shared with this party. Shopify has access to your data to provide us with (technical) support, they will never use your data for any other purpose. Shopify is obliged under the agreement we have with them to take appropriate security measures. Shopify uses cookies to collect technical information regarding your use of the software, no personal data is collected and/or stored.
E-mail and mailing lists
We send our email newsletters via Shopify. Shopify will never use your name and e-mail address for its own purposes. At the bottom of every e-mail sent automatically via our website, you will see the 'unsubscribe' link. You will then no longer receive our newsletter. Your personal data is stored securely by Shopify.
Internet provider: Gmail
We use the services of Gmail for our regular business e-mail traffic. This party has taken appropriate technical and organisational measures to prevent abuse, loss and corruption of your and our data as much as possible. Gmail does not have access to our inbox and we treat all our e-mail traffic confidentially.

We use the services of webmail. mywebwinkel for our regular business e-mail traffic. This party has taken appropriate technical and organisational measures to prevent abuse, loss and corruption of your and our data as much as possible. webmail.mywebwinkel does not have access to our mailbox and we treat all our e-mail traffic confidentially.
Payment processors:
MOLLIE
To handle (part of) the payments in our webshop, we use the platform of Mollie. Mollie processes your name, address and place of residence data and your payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organisational measures to protect your personal data. Mollie reserves the right to use your data to further improve the service and, as part of this, share (anonymised) data with third parties. All the above safeguards regarding the protection of your personal data also apply to those parts of Mollie's services for which it engages third parties. Mollie will not retain your data longer than permitted under the statutory time limits.
Shipping and logistics
Myparcel
If you place an order with us, it is our job to get your parcel delivered to you. We use the services of myparcel to carry out deliveries. This requires us to share your name, address and place of residence data with myparcel. Myparcel only uses this data for the purpose of executing the agreement. In the event that myparcel engages subcontractors, myparcel will also make your data available to these parties.
Purpose of data processing

We use your data exclusively for the purpose of providing our services. This means that the purpose of processing is always directly related to the order you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you - other than at your request - at a later time, we will ask you explicit permission to do so. Retention periods
We keep your data for as long as you are our customer. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also interpret this as a forgetting request. Based on applicable administrative obligations, we are required to retain invoices containing your (personal) data, so we will retain this data for as long as the applicable term runs. However, employees no longer have access to your client profile and documents we have produced in response to your instructions.
Your rights
Under applicable Dutch and European law, as a data subject you have certain rights in relation to personal data processed by or on behalf of us. We explain below which rights these are and how you can invoke these rights.
In principle, to prevent misuse, we only send copies and transcripts of your data to your e-mail address already known to us. You will receive all copies and transcripts of data in the machine-readable data format we use within our systems.

If you object, we will immediately cease data processing pending the resolution of your objection.
